Sony always said it's marathon, at this point Sony has been keeping up with and even surpassing the 360's speed. Don't forget that the PS3 is still behind but not by much. was looking to licence Bluray but started balking at the royalty fees that SONY was asking for. Whereas HD-DVD was a more open format. That's great when you make niche products for a specific market. Bluray however was designed for mainstream appeal.

the UCC requires that contract law provide recourse to remedy. M$ will automatically say that the recourse to remedy they provided the consumer is the extended 3 year warranty. A smart lawyer will argue THE SCOPE of remedy that M$ provided and to that drive home the point that the 360 suffers from many more defects than just general hardware failure better known as RROD. Either way they will look to settle this while the number of litigants is small, if grows out of control before its settled...

when a game goes multiplat, they have to lower the polygon count on the models, texture resolutions and size of maps so the 360's limited bandwidth can produce a decent framerate.
THIS IS WHY PS3 OWNERS lose interest in former exclusives. No one wants GIMPED titles.

My last job gave a BRAND NEW Dell Xps with vista on it and this thing would blue screen like crazy. It got so bad I gave it back to them and started using my own laptop with XP on it. I since bought a new laptop and the first thing I had the vendor do was wipe the POS off and put XP on.
