This doesn't use Sony's SDK and is legal to distribute.
However, this isn't actually the first legal homebrew. Just the first legal pkg.
Kinect deals with infrared light, black absorbs infrared light.
Consumer Reports is apparently unaware that there are different shades of black people. Kinect absolutely doesn't work as well the darker you are and basically admit it on their site.

I think the difference is that Motorstorm can "fail" once during an expo where hundreds play the game making it a bigger deal than it really is. While Kinect fails every time it's demoed.
The "N64" version is a lot more crisp.
However, it was made using an emulator to improve the original games graphics. Basically a stupid, useless comparison.

I don't know if they still do it, but if anyone lives near a Meijer (it's a mid west chain) you might be able to get a much better deal. When I first bought my 60 GB PS3 they had a deal when you sign up for a credit card you get 20% off your first purchase. Then they gave you another 10% off coupon with your first credit card purchase, and they ran a deal where everything in the store was 15% off when using your credit card. So I ended up getting $599 PS3 for around $375.
