Sony's not making you pay anything. It's up to you if you want the PSP games you already own on the vita. What other way could they have done them giving games for free.
3DS can play DS games because they are both catridges. Vita doesn't have a UMD drive so you can only get it digitally.
I don't think anyone is expecting the game till late 2012, early 2013 anyway.
