Because then, when those consoles with stolen codes go back to walmart, and little jimmy winds up with one for christmas, is he going to be stuck with a toasted console, since it would be a "duplicate" of the one the pirates modded.

Piracy is a kid's game. We all used to pirate when we were immature kids that could not afford anything and had a weaker moral compass.
Now that we have decent jobs and can afford it, why pirate? Why not give money to support the devs and companies whose creations you are enjoying?
Try getting a real job, son. There is no reason for adults to pirate anything.
What is the problem? It's not like they were paying for games anyway. I have a buddy who got banned, he's buying another xbox and staying legit with it. If more people had that outcome, MS has done a good job. Either way, the ones that stay might become legit gamers, the ones that leave won't be missed sales wise.
They don't deserve to have the service MS provides its legitimate customers.

I still can't believe people are trying to spin this into a desperate move by MS, or a dirty backstab towards gamers that have done nothing wrong. People whine about how xbox has tons of pirates and piracy is hurting the industry; MS makes a big move to ban pirates (as they have been doing for a whiiiile) and people whine about that. Sad times. People will hate on MS no matter what they do.
