Copyright laws say otherwise. Nintendo did not make those laws and the whole "fair use" thing is incredibly throughout every industry.

Where was 3D ever necessary to play Bravely Default? There wasn't really a point in the game where it felt "enhanced" with 3D.

It depends on the game for me. Normally I think a game should qualify for a remaster if it's at least ten years of age.
Same conjecture can be used for PS4. If a game runs at 60fps with a cut in resolution - people will complain. Is it ran with high resolution but with a choppy frame rate - people will complain. Smh
If that happens with a dip in resolution or graphical fidelity, people will complain about xbox's "underwhelming" performance. Smh
