I think people should be a bit concerned about this. Even if it's (as far as we know) only 5 out of 5,000 units that are failing, this opens up the potential that the PS4 is a ticking time bomb. It could fail within the hour or it could fail within 3 months. Too many unknown possibilities at this point.
I'm not surprised by this. Truth always comes out about products just days before they're released. God knows what's going to be revealed about the X1.

High resolution is 'nice' to have and I'm happy we can get there, but important to the game/gameplay itself?
Frames Per Second, on the other hand can utterly destroy gameplay if it's less than what the gameplay is expecting.

The kinect comes with the Xbox One, but having it on is optional.
so probably the same policies as Xbox One. Not a big deal.
Think about it- MS bans a console, Sony says they won't do that. But when MS's policies come out, we don't hear a peep from Sony.
