This same site gave MW3 a 7 for the same reasons it gave this a 5. If you go look at the major site reviews for this and MW3, you'll see that quite a bit.
They don't care as long as they're in the news and in everyone's face. Stories like this keep feeding the trolls and they keep right on going because they know it pisses people off.

It doesn't matter where the individual studios stand. They still pay dues the the ESA and the ESA still pays members of congress. If a company truly doesn't support it, they need to pull support from the ESA. Until then, they implicitly support it by supporting the ESA.
