From my understanding:
The game file on the cartridge wont be compatible with another user account (let's call him User X), because the save file would mess up how trophies are earned for User X
The workaround to this is that you must reset the save data, so that the cartridge has a fresh file, and then you will be able to collect trophies

I don't know how much more selection you expect out of 20 games given to you. By your comparison, Sony offered 5, but made you pick just 2, an offer that is much more limited.
How can Nintendo let you down when you are fully aware of what you are buying? It's not like they hid the launch lineup from you and revealed it after you bought the 3DS
