I have a music disc that had to activated on the pc before you could listen it and wasn't MS the DRM was so strong you had reactive it from time or would not play on the pc.
Alway on! The feature can be switched off when not needed,just like current Kinect now. I turn it off so it don't get damaged from being on when I am not using it. The 24hr game check should not be a problem,the 360 runs checks now when put a disc in and looks for who knows what besides updates. DRM was caused by people who don't like to

You will still be able to play the games you have a purchased on a disc without a internet connection that has not changed. Xbox 360 has had internet checks all the time. You can watch Tv, sports, movies, video chat etc now. Kinect has always been watching and waiting how many times have Kinect been hacked in your system?
