No they are not snooping, but they do have their kinect on to recognize certain products in your house so that they may send ads to your Xbox One accordingly.
They might not snoop but I'm pretty sure if the government understood the capabilities of this thing, MS will have no choice but to give them access when they want it. Federal Law.

Sony is doing it. Why else do you think EA capitalized on the opportunity to broadcast that they're really not the bad guys by saying "No online passes next gen"? They said that because they know both Sony and MS will be eliminating the usage of used games on their consoles.
