I'm confused. Like really confused. How is it JUST FPS games? Why is it specifically FPS games? Why was there no control? What 90 hrs? They do not know how to conduct a proper experiment and relay the results.

See the first amendment does not guarantee free speech to a citizen. It is instead a regulation on government to prevent censorship and control over what can be shown. Movies, games, and other media rely on first amendment protections. Citizens are not protected by the first amendment as it literally has nothing to do with them.
