Yeah, I'm so certain Nintendo is doing nothing right now.

Backwards Compatibility also makes it much easier to transition from on gen to another. With games still coming out on the PS3, most people will probably hold off on the PS4 and wait until next year, because they spent their money on PS3 games.
In some way it can be a blessing. Casuals seem to be moving away from console and their smart phones for piece meal gaming. This could mean less shovelware made to trick the casuals and more actual games. Declining sales means gamers are getting more selective, developers (and publishers) will have to wise up to this and make a better product or they will lose big time.
Retro Studios is been said to be working on a game that "everyone's been wanting". Rumor has it is that it's Star Fox.
Nintendo has won a number of similar cases in the past, sometimes on appeal. We have to wait and see if this is the same.

Blame Activision for releasing 1 Guitar Hero after another causing people to tire of music games.
I'd like to think all companies will do well. I do think they won't do as well as say this gen at least not at first, it'll be a slow burn. Casual gamers which made up for a lot of sales seem to be teetering away from consoles and going to IOS and Android and I doubt they want another device to watch Netflix. I'm fine with this, could mean we get some more quality games.

Going after the children? Their games are mostly catered to younger audiences. Adult just happen to play them too.
