These numbers are pretty suspect. Makes you wonder. There's no way they're accurate, unless the 41 million in september was just shipped and this is now sold to consumers.
If not, then why would they give such an inaccurate number for the purpose of a lawsuit? I'd think the more consoles said to be sold, the better for the case.

WE, MICROSOFT, not Wal-mart, not gamestop, not your fast food restaurant/ gadget shop that is always stocked with kinect because nobody is buying it, MICROSOFT, ran out of 360's.
