because they obviously paid for some level of exclusivity. Why don't they just go all the way and throw cash at the dev for total exclusivity?
3rd party or indie has nothing to do with it, unless that developer goes on record as saying they WILL NEVER do an exclusive deal. I would say most devs would go exclusive if the money is right.

lol honestly i was elated over the jugglies for like 2 seconds and then after the barrage of sprite effects + enemies kicks in i was over it. it's a pain in the ass when you lose your weapon amongst the chaos lol

I agree with this, however, since I will be supporting SONY with a day1 purchase of a PS4 and they have a stellar rep with their 1st parties, I wouldn't mind if SONY does end up buying them.

oh, ok i guess it's good that Nintendo's MAIN console's sales are on par with their competitors handheld, irrespective to whatever region those number are coming from. That's certainly what I would be aiming for if it were my business :/
