From Nintendo's stand point? Likely, ya. Which company in their right mind, wants to run production, QA, packaging, shipping, tech support, warranty, of multiple products, if they have the choice to consolidate into one? You can bet your ass Nintendo will be pushing Switch to replace 3DS.
If Switch shows any sense of staying power, Nintendo will surely drop first party support to 3DS shortly after, and phase it out.
Can't imagine any ban is upheld based solely on the "automated ban system". When someone gets flagged, you can bet their data is analyzed. There is no hiding from the input data collected on their servers. If you're banned, it's for a definitive reason. Not because "Woops, I guess you're just too damn good!"
