That would be too much of a pain to keep track of, especially with them refurbishing systems and swapping drives. I doubt it.
Besides, it's not a violation of xbl tos to swap DVD-ROM drives in your 360, though they might have different firmware revisions, and that would throw the plan out the window.
well actually Im a member at Xbox-Scene. If anyone was getting banned it would be all over the headlines at the site. Go check, not one person @ XBS, the biggest Xbox hacking site on the web, has been banned.

I'm currently boycotting these type of EA games, ex. all the sports games, NFS: Carbon, etc.
I still buy games like LOTR: TBFME II, though. Can't get those anywhere else, and they're not yearly money hogs.
I think it looks pathetic, not necessarily graphics, but just the game type. It's all about getting a foothold in the jap market though, I suppose. PS3's library is too focused toward japan and cheesy games, that's one reason I dislike PS3.

None of those apply to the 360 anymore, it's reached maturity as of November (Game quality, stability, and genre variety).
So those reasons only apply to PS3.
Here's an even bigger hint, the U.S.A. is a democratic republic.
