You can't get banned for getting credits without the use of hacks/mods. So this way should not get you banned, only make you reach the credit cap for the day.

This is true however Halo: Reach didn't deserve a 10/10 for some of the bugs within the game.
The game wasn't perfect thus it didn't get a perfect score.

That's how you get that many people. Breaking street dates usually ends in receiving a fine and if the retailer does it a few times they may not receive the games on launch date.
Of course some stores will always get the game on time for release date providing they are big enough, but smaller stores like ShopKo or K-Mart can in fact lose the ability to get games before launch, and thus lose sales when the game launches.

It's their service they can ban you for whatever they want. You can't sue them.
However you won't get banned for playing a retail copy early, not your fault you got the game.

Well I'd guess that if a lot of gamers change their location to one which was once enough to receive a ban, Microsoft might do more research before banning someone.
If Microsoft only makes game for the Kinect I will be done with them. I will switch over PS3 in a heartbeat. It wouldn't be too hard since I already own a PS3 and would then just need to buy the Multi-platform games on the PS3
