Yes but they then removed the GS aswell, so they are completely void of PS2 hardware. They need to emulate the GS before they have any hope of implementing any PS2 compatability without the hardware in there
Sony ALREADY emulate the EE chip. They took out the EE for the European 60GB versions and emulated it, leaving only the GS in there. It's the GS they need to learn to emulate

It was probably easier for Sony to just se the whole XMB in-game rather than change it from the out of game one. That and they likely wanted to keep it universal across the system
