If you read the hole terms and conditions thing that you click agree on you may find some draconian clause thats states something like this is OK.
As for being legal................ We have found T&C's and EULA's to be legally invalid before. I'm not saying they do have something like this in place just funny if they did. Like that one that said they owned your soul upon clicking agree.

I do agree. I have a cheap system running a 4890x2 and it is a good card. However when it comes to BF3 I am going to need an upgrade to turn it up.
My other system will be just fine at max with a DX11 series card 5 card, which the 4890 unfortunately isn't.
