If he's talking about how there's not enough space on it then why doesn't he make a disc that installs some a part of the game on the hdd. I'm pretty sure it has enough space on it to accommodate for it.
First off why was the console on if it had RROD? Did he just love the look of the 3 red lights? Oh and MS issued replacement cords to Xbox's not Xbox 360's. This heat issue is also why my console is well out in air. He also can't sue MS because in their instructions they tell you to give it plenty of air.

Game runs damn near perfectly on 360.
