It's a free country, the man can say whatever he damn well pleases. Put yourself in a developer's shoes and ask yourself how you would react towards people who say they hate a game you busted your ass on. Jaffe is one of the few authentic people left in the gaming industry.

I doubt it. As long as Sony doesn't send a cease and desist letter and they aren't profiting from the game they should be ok.
Remember Sony never owned Crash, so it would be the first time the company would own the rights to the IP if a deal were to occur. Universal owned rights to both Crash and Spyro and that's why they were sold to Activision. I'm pretty sure if Sony had the rights they would never have even dreamed of parting with both Crash and Spyro.
