Kinect not being able to recognize gestures, that's hardware (the camera). The software is doing its best to decode and understand the gestures, but, no matter how good the software is, the limitation of the Kinect hardware still make it impossible for the software to decode the gesture correctly. Basically, the hardware is not accurate enough and in so, does not provide enough accurate information for the software to do anything useful with it.
