gaikai and OnLive do not do the same thing. gaikai streams game demos to web browsers. OnLive has been selling games for years on their own platform, playable on macs, PCs, tablets, phones, and TVs via their own hardware. This includes it's own social network, voice chat, and features like Arena and spectating that are not available on any other platform.
As an owner of both a 360 and a PS3, I can tell you myself that the first two reasons are the only two legitimate reasons why anyone would pick a PS3 over a 360. Xbox controllers can get a recharging attachment and the rest of the reasons are opinions.
In my opinion, Sony should have a lower grade for the first half of the year. The hacking incident was definitely an unfortunate blow to Sony, but Killzone 3 and SOCOM 4 haven’t been faring too well since their releases. The community really sort of ditched those games for MW3 and BF3, or even jumping consoles altogether.
Im an Xbox fanboy, but I also understand that my 360 would not be what it is today if they didn't have to compete so severly with Sony. The same can be said vice-versa. I tip my hat to you Playstation, hang in there.
The ban also had nothing to do with the free points from the rewards site. This banning is from using point codes from a code generator. So if someone gave you a code and you used it even if you didn't know it wasn't a legit code you're still "guilty".
