Yea, 3rd parties can continue current DRM practices such as online code. If you're inferring that they can do some form of DRM that MS tried to implement prior to reversing course, such as checking every 24 hours, then you're mistaken.

Well you can just buy it. I don't think a camera is needed to play videogames. You mentioned Wii U but does Wii U have any games where the camera is such an important and integral part of the package that without it, the game wouldn't be that great? I don't think so.

Also your argument makes no sense. Those games are from 3rd party publishers. They have no console. Sony and MS provides the console to supply the games on. However, Sony and MS have to make money. So distinguish the games, they fund their own studios...
