I agree. After Tim and Chris Stamper left I knew Rare wasn't going to be the same.
They still make good games but nothing truly epic.

Viva Pinata 2 and Banjo-Kazooie were both excellent games.
Plus Left4Dead and a bunch of great Arcade games such as Braid and Castle Crashers. I don't really play consoles that much but I bet there was a lot more.

Illegally downloaded copy of the game does not mean a lost sale. Most people that download the game illegally wouldn't of bought it in the first place.
40,000 downloads does not = 40,000 lost sales.
