A game doesn't have to be perfect to get a 10. 10 doesn't signify a perfect game, there IS no such thing as a perfect game. 10 just represents the maximum amount of enjoyability you can get out of a game.

Target audience is completely different, it's not just about genres. Skyrim is more threatened by, say, Skyward Sword or maybe even Revelations than MW3.
Uh, Activision announced MW3- OFFICIALLY- for both the Wii and the DS a long time ago, along with announcing that Treyarch and N+ will be developing them respectively. Shitty article, this.
It goes more head-to-head with Skyward Sword than Skyrim, MW3 and Skyrim are not similar at all. They have a completely different target audience.
1) Completely different target audiences
2) Completely different genres
3) Skyrim is for hardcore RPG fanatics, MW3 is mainly for... well, Michael Bay fans
4) THEY'RE NOT EVEN RELEASING ON THE SAME DAY
