the firmware is not forcing you to buy things. its just there to give you the option if you are interested in getting/buying stuff, which is optional to look at. all you have to do is to change it in the settings section.
at the end of the day its not bothering no one. the PSN is a free service as well. XBL forces you to see ads all over the place every time you move that analog stick, despite paying $50/year. so whats the complaints about?

according to the rumors, one of the reasons for the lag that was shown on the 360's natal demo back at E3 was probably because it didnt run at 60 frames per second.
Sony had prototype HD eyetoy cameras running at E3 back in 2006. they didnt went with that approach because of the amount of power needed to run such a thing. so they went with the final version of the PS eye, which runs at 480p at 60fps.
