Various places people talk about how Nintendo is bad for fan made games using their IPs. Some go on about fair use mostly because unlike the last Pokemon project, the sprites aren't ripped off the games and instead models are made themselves.

Its not really that much more expensive then your method. You still need that capture card itself which is the largest expense. That splitter is $20, this converter box was $30 when I bought it
Just read up on those devices, they are a HDMI recording device, which claim to passthrough however they are still affected by HDCP? Sounds like a bad case of false advertising
