I hate the sue first mentality too, but until some power players (like MS or Sony) lose from it, things won't change.
If a company gets sued a few times for fudging things, they will either
1. Stop fudging things.
2. Support legal reform to protect themselves.
Both options are good for our society. In the long term, these frivolous suits might help stop other frivolous suits.

If Nintendo had followed MS and Sony, and made a HD gaming platform with a traditional controller, the die-hard fans would not have kept them in business.
Instead, they took a risk and innovated.
It sucks for gamers, but the money was in sequels and derivative games. Now it's in games with casual appeal.

I feel the exact opposite.
I'm honestly disappointed with the x360 and the PS3 this generation. They are just repeating the last generation with better processors. It's more like an upgrade to the last generation.
I just don't think graphics alone can account for a new generation. In previous generation jumps we've seen the move from cartridges to CDs. From 2D to 3D. We've seen huge controller improvements.

I couldn't disagree more. Let's face it, none of the 3 systems have the graphics we expect for this game.
The difference is that on the Wii, all I needed were passable graphics. When I'm swinging through the city, I don't look at textures. When I'm web rodeoing bod guys, I don't look at the character models.
The Wii version is still fun.
If you are only interested in graphics, this would be a perfect game to criticize. The graphics are bad.
