What category does this game fall into? It's like a racing/fighting game. A need for speed mixed with ramp on dirt. No developer would take a chance making this type of game because it wouldn't be profitable enough. Just like full auto was a failure on the 360, no one wants to buy those types of games on the 360. Maybe people on the PS3 would like to go around in a circle very slowly while trying to run other people off the road. Sounds like fun.

Is he on crack? There is no way he will win, MSFT already stated that they will fix any 360 affected by the update, unless it's modded. If it's modded you can forget it, and you can forget suing too. MSFT is not responsible for what happens if you mod you system.
