BlackKnight, I completely agree. He owns that console. Just as anyone would own their PC.

1) His hack doesn't allow for piracy anymore than OtherOS, which was on the console for YEARS and could allow emulation of "little games" like Castlevania. Sony is just as much at fault for having that software available on the PS3.

do you even realize that the CFW isn't meant to pirate games. Even w/ the actual code you can't literally pirate games. AND you can't modify the code to allow for pirated games

You'd need a whole new code.

also geohot had to have solicited the donation, via a link or whatever. Since there was no solicitation, geohot didn't break the law.

actually, it's only illegal if he solicited the donation, so I take it back. he can take donations from whomever he wants as long as he doesn't ask for them.

Sorry, but this sounds fishy as hell. It's clear that Sony needs all the help they can get w/ this case. It's underhanded to even attempt to do something like this. Geohot and his people in general know better than to take donations. And if he did take donations (highly unlikely), he deserves to go down for profiting off of it.

If he didn't take any money, than I think it works against Sony and shows how manipulative they can be...

The tinkering of the GUI is one of the charges that Sony is bringing up against Geohot.

The security keys of the software is another issue, however. Unfortunately for Sony, Geohot has already won this case w/ the hacked security keys on the iPhone:

"allow iPhone owners to use their phones with applications that are not available from Apple's store, and to unlock their iPhones for use with unapproved carriers."

XMB is a GUI and unfortunately it's not illegal to hack a GUI, closed or not.

And as long as it's not for profit, it's not illegal to distribute code for a GUI because it's simply not illegal. The same goes w/ the iPhone OS. Geohot won that case, if you didn't know.

I would agree if he were selling the altered code at a profit. But since he's not, there's no money being taken away from Sony.

Again, if he sold it at a profit, it would be downright illegal, but since he's not, Sony is not obligated to consider it a threat.

why does irepbtown need to give a better analogy, yours is the one that sucks.

geohot isn't giving "drugs," the distribution sites are the ones "distributing the illegal stuff (hacked games, etc).

all geohot is doing is providing the little plastic baggies that you can distribute the "drugs" in

daemon tools is the equivalent of this on the PC, yet that mounting software is in absolutely no danger of being deemed illegal.

it runs illegally obtained "hacked" software

geohot's tool is no different. but w/ no software distribution infringement, there's no law being broken.
