I don't think Gearbox should talk. I have Borderlands on the PS3 and it's not the lack of mics hurting anyone...it's their chat quality hurting the online experience. It's never works.

Everybody wants betas to play the game early even though they are glitchy and buggy. Why not put up with a few minor bugs in a retail release until it gets patched? I'm fine having the game in my hand a few weeks earlier with some minor issues.
Then again I would be really pissed if I didn't have a online connection :)

What they need to do is send out versions for review with a unique serial number or something in the code. That way when it shows up for download online they know who's door to go knocking on.
