The hackers have a program used to generate trophy timestamp. it's pretty easy for them to put a timestamp on their trophy to make them look legit. As long as they do that, it's impossible to detect.
Only way for Sony to detect is if someone doesn't add timestamp or has mysteriously collected the trophy for Win 100 matchs online before winning 1 match online.
Sony can't win. Apple couldn't take him down, so there is no way Sony will either. Not only will they lose, they will have to pay him his lawyers fees at the end.

The release was too close to other big titles. Also, the games were good, but not that great.
