Wouldn't Sony have been made aware of what was going to happen seeing as they own Bungie or were they kept in the dark ?

People can request information from other parties in court cases all the time if it's relevant to the case and I'm sure that if it was obtained by corporate espionage then MS would be in legal trouble
It was part of information that was requested from Sony that they willingly provided to the court as part of the court case so there is nothing illegal about it.
MS did say in that other article that the series consoles were at 21M+ and this article says 21.96
