Immediately on start up you have to download the patch. If you don't you aren't permitted to go any further. All of videos of the people showing the dashboard have already downloaded the patch. I'm not sure why this is so hard for people to understand. I mean how would you get banned before you even connected the system to the network?
The contest ended today, so they probably won't have the consoles until November 12th at the earliest.
