I seriously hope that this judge realizes that as consumers we do not lease products from these companies we buy them outright. I know this is a radical idea but this means that they are ours to do with what we want. If I want custom firmware on my PS3 then so be it.
However I at the same time look down upon pirates. But to say that jailbreaking the system is to pirate, would be like saying everyone who owns a gun uses it for crime.
Yeah they completely forgot that movie that ripped off Uncharted 2, it was called something like Indiana Jones, and it also had a cocky lead protagonist with a beautiful women companion and Asian sidekick. Or maybe just maybe these stereotypical roles have been around for so long that to suddenly trademark Uncharted with their creation signals that you are a completely retarded "journalist" (and I use that term lightly).
Let me give you another example that is merely paraphrased.
A man buys a simple monkey wrench, but decides for some odd reason he would like to alter it so their is now a blade in place of the teeth. The man proceeds to assault a neighbor with said wrench. Does Craftsman (the maker of the wrench) sue the man or is he just convicted with the crime.

Call me old school but I remember when Bungie hadn't even first advertised Halo (And even when they did it was a computer exclusive game). But anyway Bungie was a AAA developer even before Halo, the Marathon, and Myth series had huge followings when they were launched. Hell I still play Marathon to finish all the Vidmaster challenges.
Their is a reason they reference their old school games so heavily not just cause they made them but their fans still follow Bungie.
