PSP didn't fail....In fact its the 7th highest selling video game hardware of all time including consoles...

Lets not forget its the most swooned over hardware by devs due to them having a part of its creation as well as easy development tools. When developers support a product, nothing but good things can come about it.
Dual analog sticks, Monster Hunter, Call of Duty and integrated online with voice chat with the most flexible control scheme of any gaming hardware before it. These are a first for portable gaming and they will make a difference to a good margin of gamers.
The mobile market changes fast but I believe being the first in some heavily sought after features will help it claim its stake. Now they just need the games which from what I can see is starting off pretty good.

You're getting disagrees because "Sony" doesn't have these IP's. Sony's lawyers do AND Geohots lawyers have them. It was used for nothing other than a jurisdiction claim. Sony lawyers said 6000 people from California downloaded the hack, Geohots lawyers said more people outside of California downloaded the hack. Both groups were using these IP's for the same thing.
