You do not own your save game progress, you merely own a "license" to use it. It is the property of Nintendo. You merely have permission to use it in a very specific way, which Nintendo controls.
Nintendo can use your save files for anything it pleases. Now bend over and take it dry.

Given how much more popular gaming is these days in comparison to prior console releases, these numbers aren't exactly spectacular or anything.
