The numbers are shipped not sold. It will take a long time for it to sell 3.8 million, lol. And don't give me that shipped = sold BS.
@MAJ0R - No YOU'RE getting confused between the 2 types of shipping. If Sony ships it to any retailer it is considered as shipped, and if the retailer (like Amazon you mentioned) ships it to the consumer it is considered sold.

That power is not meant for devs and is meant strictly for OS purposes only.
So its not like 3DS is using 75% of its power, its using full of what its supposed to. If this rumor is true, then Nintendo will let developers to now use 125%, compromising on OS features.
Nintendo DS has been extremely slow after Pokemon Black/White released in Feb. 3DS launch wasn't as successful as Nintendo had hoped, no best seller game was released till last week, and the company is reporting its first annual loss since 1981. So obviously these factors have contributed to Ninty losing its share in the market. But its back on track with Super Mario 3D Land finally seeing release, and I think numbers will be back to normal again.
