Yes, now if only Nintendo could be control freaks with the software that gets published on their system.

Nintendo demands are fair enough, if this developer can't comply with that then there is nothing wrong here...

This was not an evaluation of the game, was all about the developer.

Seems like if it doesn't involve flailing your arms around like a moron nintendo doesn't like it....

The guy is a contractor on a Wii game. He doesn't list any shipped games under his studio's name. Thus his studio has no real experience making games which automatically gets a thumbs down then on top of that he has one of his games at the bottom of the page. Not exactly some thing that seperates him from the pack.

Yet if he get his sh!t together he can make a new company and apply earlier. Seriously He should contact some other Wii ware developers to see if his apps is good enough. Most people are pretty helpful. I say he should contact cross beam studio since it seem they need a programmer what what I'm hearing.

the letter was on there , the demands that nintendo had were that the developer had to have a safe and secure place to use the sdk. the studio also needed to be capable of maitaining confidentiality of anything between them and nintendo.

By publicly posting this letter i think they have just made their chances worse for becoming a developer because they just violated one of the rules.

Lots of little developers have made it onto wiiware, the Nnnnooo studio developed pop and they are a tiny studio with almost no real experience. Even the spogs racing studio, then some geometrx wars studio too. Its obviously hard or impossible.

just develop for XNA. Screw Nintendo.

This is actually a very common occurence with a non-American company. In my experience, if you want a product sample or documentation for anything from a American company they will fedex it to you next day. They want you to use their product and customer service is usually top notch.

If you want something from an Asian or European company, you have to jump through their hoops. Basically, you have to prove yourself worthy of using their product. It is is really bizarre. Americans have really mastered the art of customer service.

Even worse is Nintendo is among the companies that have the worst reputation with regards to third party developers. Even Sony's PS SDK for edu requires the school to buy equipment and is not even open to anyone. MS is the only company that has got it right. Give them the tools (XNA) and if the developer makes great games, adopt them into the Xbox Live program instead of shutting them out at the door.

Before anyone says I'm biased, I'm of 100% Asian descent whom was born and raised in Europe until I moved to the US in the last 7-8 years. I own a Xbox 360 and Wii and also has the Gunmetal PS3 MGS4 LE on order. I do programming for a living as well with a degree in Electrical Engineer and Computer Science.

Nintendo was spot on in their decision to avoid Xiotex Studios. I can't imagine any major publisher touching anything from this studio ever given a "bio" that reads, "Xiotex Studios was formed as a small company to host the games that I had been developing in my spare time while working for ‘proper’ games companies." Xiotex is one lawsuit away from being shutdown, because they've just announced to the world that they're looking to publish games OWNED by this guy's former employer.

News flash, if you develop games for a "proper" games company you don't even own the rights to a game you develop in the bedroom of your house in the suburbs on nights & weekends. This guy needs to re-read the intellectual property agreement he signed with his former employer & then either find a new job or develop utility software for the iPhone, but ABSOLUTELY NO GAMES.

In total agreement with you which is why whenever I join a company after the formation of Xiotex Studios I have it written in the contract with those companies that the games I develop under the banner of Xiotex Studios belong to Xiotex Studios and nobody else. I am not going to lie and say this is not an issue because some companies don't like it but the last 2 I have worked for have been fine and to ensure the status quo I am totally transparent in my business so that those companies know what I am up to. It had even got to the point where my last boss upon hearing I had applied for WiiWare registration gave me a free licence to use the companies own Wii engine for Xiotex Studios games.

But the issue here is that at no point did Nintendo ask any questions about the game - the whole registration rested on if I had external offices somewhere - nothing more.

As for the flash games - they are a fun side project that also happen to bring in a little money, I mean how else without publisher funding is an indie developer supposed to be able to afford offices? Especially in London where I live. I am not alone in this and in fact in industry circles a few other developers who are making the move to indie want to put together a petition for Nintendo to relax the rules. I can understand not giving dev kits to any old person but most of us are legal entities (i.e. Limited company) and have quite a bit of experience in the industry.

I think it means this guy didnt meet the qualifications to be a Wiiware developer and some douche wants to try to spin it into signs that Nintendo is the devil of gaming. Kinda pathetic but it wil lgive the haters new material/

Or perhaps raise awareness and perhaps make a difference and get policy changed more in line with the general impression Nintendo made when they announced WiiWare.

I mean, look at XBLA - Microsoft opened the doors to the large publishers and they flooded it with crap because it is lower cost than a shelf based game which squeezed the smaller developers out.

for all we know it could of been a japanese style porno game. We have no idea why they denied it.

You guys are so quick to bash Nintendo i personally think nintendo just has to many games to release and are not excepting yet another title to release.Atleast that would explain why they didnt even ask him what the game was about.I mean think about it nintendo is already releases alot of wiiware every monday(4-5 games),thats every monday.If nintendo starts releasing more then that every week.Games that ar not up to par would not sell at all because there are to many choices and people would buy the best games.If you release a small amount each week.They all sell.Supply and demand.The less you provide, the more people want the more people will buy what is out.

xiotex why didn't you just rent out your bosses office space or some thing? I mean you would still own your company and you could have a secure place to work on your game. If you boss gave you the engine then he should be fine with you using a room after hours right? Maybe you could go in with your boss on a joint development idea where the game is your IP and he is the tools provider. I mean this is business man. You are starting your own company here this is no art gallery. If you hit a hurtle jump it. Realistically try this with XNA or the PSn network. The bar is pretty low for Wii ware games. I mean come on Luc Bernard can get in and you can't?

You can give up if you are serious and I'm glad you posted here. I got a similar set up as you do and yes money grabbers don't like it but no one should have their ideas thrown away just because it will not work in a FPS.

Work some thing out with your boss and try not to put your business out in the street ok. It makes you look like a drama queen. That is what people are reacting too on this post. Try changing your article to IS the Wiiware service a lie? Then explain that you hope it is not. That way you can get help yet if you just wanted to bash the Wii then go ahead. This is why companies have PR. People will give you a pass now because you are small but they are not as forgiving when you are bigger. Good luck with every thing man!
