People aren't getting banned for nothing. I'm sure it happens to a few, but I'd wager that most people who get banned deserve it.
There's nothing stopping you from doing as you please with the console. But when you take the sticker off of the drive door you agree to use it in the way Microsoft says is acceptable. So mod away, but don't get all upset when you lose warranty coverage or XBL access.
Funny how everyone is complaining about MS abusing their customers. In my opinion MS isn't doing enough to get rid of scumbag users on XBL. My personal guess is that your personal guess is wrong. My personal guess is that because there is a lack of standardization among displays that it leads to a lot of problems, particularly the low-end sets. SD content looks a lot better on some sets than others, and since the majority of programming is still in SD people think that HD displays are just crappy looking. Several people I know don't like the black bars on the side of the screen when watching SD stuff.

It isn't too late to be jumping into this market. Flash has been the only product of it's kind for quite a while now, so with Web 2.0 picking up steam it only stands to reason that there would be another product jumping out there.
From my perspective it is a good thing. It will force Adobe to tighten up the pitiful resource hog that Flash has become.
And Vista hasn't been forced upon anyone. There's always MacOS or Linux if Windows isn't to your taste.

Of all of the games on the list only SMG does something that really hasn't been done before. Sure it's a platformer, but there has never been a platformer that plays quite like this one. I'm not sure that I agree that it should be game of the year, but it is a good game.
I don't think that COD4 should have won, though. For as good as it is, the thing is still just another shooter.
