I a basing my comments on the legal definition not a popular definition of one. I am not saying they will. But legally they can and any complainers would not have a legal leg to stand on.
Having said that, their statement clearly says no XBL till the 19th, so no widespread banning can be extrapolated from that.
But remember free does not necessarily mean do what you like. A lot of FREE software have terms and conditions. Look at the open source world. There are free...
MS own the firmware. If you use outside their terms, i.e. install it early, you are a priate.

Clearing cache does not but exactly that plus all the updates you may have download on you HDD.
Reformatting you HDD does not change the firmware flashed on the 360 itself.

The flash memory in the 360 itself is updated. only the additional stuff is saved to HDD or memory card

Have been watching the videos on Gamersyde. I am 3000 miles away from my 360 and PS3. Not bothered by the scores. at the end of the day, it is my type of game, hence pre-ordered
