Good, as they should! A game mechanic like that shouldn't be locked behind a patent, and Nintendo didn't invent it either.
Nintendo wants to keep wasting money on bullshit lawsuits, real smart in this economy. They should put that money aside for other game projects. On the other hand, I don't care if they waste it all either, and they are screwed in the future maybe that will teach them a lesson.

i think Nintendo got a bit arrogant after having success with the wii they thought they could throw anything out there and people would lap it up, and they didn't.
most people have been confused (at first) by what nintendo was actually trying to sell, 3DS was it just a ds with a 3D screen was the wii u just a new controller for the wii?
they had an arrogance about them, that was quickly brought down to earth when people started to question their sensibilities. now they have done a (wii) U turn they can see where their heads are at and finally come to some sense in their market strategy.
I for one cant wait for the wii u. just hope they get it right.
