Good, as they should! A game mechanic like that shouldn't be locked behind a patent, and Nintendo didn't invent it either.
Nintendo wants to keep wasting money on bullshit lawsuits, real smart in this economy. They should put that money aside for other game projects. On the other hand, I don't care if they waste it all either, and they are screwed in the future maybe that will teach them a lesson.

a couple of years ago i would have agreed with a Nintendo executive about making sure of the quality of whats released on their consoles... but after the Wii?? with the MASSIVE amount of shovelware??? For them to still use this kind of phrases in response to their slow progress in the past years in the online aspect is just ridiculous...
BTW im not saying the wii has no good games, the opposite, it has really great games, but there is hardly any console with the amount of shovelware the wii has
Thing is, Nintendo themselves rarely make shovelware - even their casual games like Wii Sports have a lot of effort put into them.
Shovelware is due to third parties wanting a piece of the Wii pie, but not willing to devote any time to making their games good. Titles like this for example.
