Good, as they should! A game mechanic like that shouldn't be locked behind a patent, and Nintendo didn't invent it either.
Nintendo wants to keep wasting money on bullshit lawsuits, real smart in this economy. They should put that money aside for other game projects. On the other hand, I don't care if they waste it all either, and they are screwed in the future maybe that will teach them a lesson.

So if they go down, they go down entirely.

nintendo's hardware future is not uncertain at all...wiiu will sell like crazy...its too much of every gaming possibilities in one console...of course haters will hate but at the right price..its a done deal...and 3ds is about to take off
uncertain? and they are just about to release the best and most powerfull hardware that they have released to date the future looks bright if u ask me for nintendo
Nintendo have always been very conservative when it comes to specs of their consoles. They just don't pull unrealistic numbers out of their ass like certain other companies.
The people who write those articles are just doing so to get clicks.
