It would seem that Nintendo is going to force the issue and make the opening gambit for the next console generation. There are a few obvious reasons as to why. But there are also a few that may surprise you.

Good, as they should! A game mechanic like that shouldn't be locked behind a patent, and Nintendo didn't invent it either.
Nintendo wants to keep wasting money on bullshit lawsuits, real smart in this economy. They should put that money aside for other game projects. On the other hand, I don't care if they waste it all either, and they are screwed in the future maybe that will teach them a lesson.

I agree with the risk and the money. Depending how much it took to develop they could easily make another console if it doesn't do as expected. Wii made a fortune and they will be riding on that success for a while
Finally, an awesome analysis. This is worth the read guys and finally someone noted the importance of Masahiro Sakurai (Super Smash Bros, Kirby, Kid Icarus 3DS)! He is so much like Miyamoto, confident in his craft but demanding in a good way. This guy is definitely working on "Project Cafe" as we chat. Nintendo doesn't want to risk losing him. Nintendo is in perfect position to release a new console than they have ever been financially and market wise.
The part about development costs must stay manageable is so true. Competition is coming from even cheap ass games on mobiles. For this next gen to go higher in development costs too much is too risky. It's better to be more creative anyway. If this console is a breeze to develop for, it will have support. E3 hurry up on details.
As far as exclusives...i do think "Project Cafe" will have many third party exclusives...then maybe ported to future or current systems. It's obvious because development has to start somewhere, why not on the new console?
Can we get any more delusional? This article isn't based in reality at all. We need less articles from the kool-aide- drinking-cult-members-of-Ninte ndo and more articles from people that at least TRY to stay objective.
Why they are acting now? All you need to do is look at their Japan and US sales to figure it out... the Wii is on a clear downward trend. When you see your sales constantly going down for the better part of a year you realize its time to get your next platform ready. It doesn't matter one bit that the Wii still has a huge lead overall...its now losing ground to both other consoles at a steady rate. Time to introduce the next money machine and try and re-capture their 1st place trend for the consoles.
I was thinking this before i read this artcle. They really are in a good spot and i agree with what he said.
