Good, as they should! A game mechanic like that shouldn't be locked behind a patent, and Nintendo didn't invent it either.
Nintendo wants to keep wasting money on bullshit lawsuits, real smart in this economy. They should put that money aside for other game projects. On the other hand, I don't care if they waste it all either, and they are screwed in the future maybe that will teach them a lesson.

the wii is dead already! its just a zombie right now. there are about 5 games to see the wii through this year and absolutely nothing beyond that.
nintendo knows the wii is on its knees, hence project cafes imminent release.
its not about thinking only from my perspective, im talking about events that have actually happened. you are being over optimistic (deluded) to think nintendo will support the current user base on wii when cafe arrives on the scene, especially considering the state of the wii at the moment.
the casuals may still be satisfied with their wii in 2012 and beyond, but for the core gamers the cafe cant come soon enough.
its coming up to the 5th month in 2011 and still zero games of any worth have been released for wii. sure there will be a handful by the time the year is through, but beyond that there is nothing. core gamers know this and so the cafe will be anticipated because it will mean games are on the way!
as i said in my earlier post, nintendo said themselves that wii software has taken a backseat due to the 3ds. and a lot of wii projects have been pushed back as a result. so they are having problems making wii and 3ds co exist as it is, let alone bringing cafe into the picture.
it just wont happen, so wii is being phased out. when cafe arrives you may as well throw the wii in the cupboard because cafe will make it obsolete in an instant! only casuals who are completely oblivious to cafe will continue playing the wii and stupidly keep checking for new wii software. there will be no new software, not major titles from nintendo anyway- only shovelware and games that get yearly updates.
