Good, as they should! A game mechanic like that shouldn't be locked behind a patent, and Nintendo didn't invent it either.
Nintendo wants to keep wasting money on bullshit lawsuits, real smart in this economy. They should put that money aside for other game projects. On the other hand, I don't care if they waste it all either, and they are screwed in the future maybe that will teach them a lesson.

well it should be more powerfull than the current that should be normal, but then sony or microsoft will release another one more powerfull, rinse and repeat.
Even if it is more powerful it's likely going to be catered to casuals yet again so it's hard to me to get excited about. I understand many people like that sort of thing but I'm not one of them.
i'm guessing just slighlty more [or on par] with current systems [PS3 / 360] power like how Wii was with Xbox1 / PS2. Nintendo seem to think less is better tech wise but who knows,maybe they're thinking bigger this time?
Maybe this time, Ninty will give us a console based Pokemon?
