Next-Gen spoke with an attorney, who is not involved in this particular case and wished to remain anonymous. He warned, "It should make anyone that has middleware nervous if the licensee of that middleware can make out a claim for damages based on the quality of the middleware provided."

"If Silicon Knights wins, the impact would be far greater than if Epic won. A win for the licensee would upset all the conventions protecting the licensor from this kind of exposure," he added.

This has nothing to do with the quality of SK's output and everything to do with honouring contracts.

If Epic were in breach of the contract, then SK has every right to go after them. There's far too much money riding on games these days to allow your middleware provider to not uphold their end of the bargain.

I don't think it would be bad for the industry at all if SK won. It would mean that middleware companies have to be in a position to provide support and the tools they promise; or in other words they meet the conditions they agree/set out in their contracts.

But sure, if Epic win, then SK lose a lot of credibility...

would have chilling effect on the licensing of IP between video game developers b/c it would open the floodgates to litigation in what is an increasingly capital intensive development environment.

As for Epic's disclaimer courts will generally interpret such things narrowly and against the person or company relying on it. In any event 80% of litigation settle.
