Good, as they should! A game mechanic like that shouldn't be locked behind a patent, and Nintendo didn't invent it either.
Nintendo wants to keep wasting money on bullshit lawsuits, real smart in this economy. They should put that money aside for other game projects. On the other hand, I don't care if they waste it all either, and they are screwed in the future maybe that will teach them a lesson.

try arma2 a pc exclusive then tell me that, true pc games aren't just most pc games are multiplats now and have to be dumbed down for console nubz, i bet you 99% of console gamers couldn't even get a take off in dcs black shark heli sim, and definitely couldn't get falcon 4.0 going. hell consoles never even had a true racing sim yet ive played the new gran turismo though on the hardest settings thats finally getting close to a real sim and most ppl prolly won't even touch that with a controller on those settings. pc=realistic if you want arcade stuff get a console thats all they have but pc also has has arcade stuff so n/m just get a pc!!
the old ubi soft tom clancy games like the first ghost recon had more tactics and were more in depth than these new console fps games also imagine if that grade of fps was still made today fps games would be amazing.

For the most part yes, with the exception of games as tough as Demons Souls.
Hard is subjective. In the early days of PC gaming, take Bard's Tale. Great RPG. Well, to make it hard, there were darkness areas with spinner rooms. Dramatically increased the difficulty and play time as you had to map and remember spinner rooms on dark grids.
Is that really hard, or artificial difficulty? I found it to be a waste of my time. Yeah, I could spend hours memorizing in the dark, but that's not particularly enjoyable. Depends on what makes the game hard.
Prince of Persia Remake for XBLA/PSN, that kind of hard is a part of gameplay and good. Action adventures where treasures are a glowing pixel at the top left of the screen on top of chapel tower if for some ridiculous reason you stop there and look up. Not hard. Artificial difficulty. Waste of time.
Depeneds on what your definition of hard is, how a game is made hard, and what you find enjoyable. Some people enjoy getting immersed in an interactive adventure, others enjoy fast twitch before the other guy, some have time and inclination to memorize maps and respawn points. While others spend hours getting timing right of jumping and hitting pixels just right ... you know, about a quarter inch from the light colored pixels or you'll fall to your death.
Buy the game you enjoy. One man's garbage is another man's treasure, and vice versa.
Edit: You must also remember, with the average gamer being 30-something, most gamers don't sit for 8-10hrs plowing through games. They play a couple hours, maybe more, over the weekend. And the juggernauts (Halo, Gears, etc.) are multiplayer games in which people buy and never even play the campaign. For games like that, how much development time can you expect to go into a single player campaign? Co-op campaign is different. There are many factors to consider. The solution, more games. More gamers, more developers, more games.
